Court Overturns Trump’s $100K H-1B Fee, Impacting Business Costs.

A federal court in the United States has struck down a $100,000 application fee on new H-1B visas, a policy introduced by former President Donald Trump. The court’s decision marks a significant blow to the immigration agenda of the previous administration, which had aimed to reduce reliance on foreign labor by imposing the hefty fee.

Judge Leo Sorokin delivered the ruling in a case initiated by a group of state attorneys general. The court concluded that the fee effectively functioned as a tax, which the president was not authorized by Congress to implement. Sorokin emphasized that the agencies responsible for processing H-1B visas lacked the legal authority to enforce the fee, as it extended beyond the executive branch’s powers. He also highlighted the potential adverse impacts on crucial industries like healthcare and education, which depend heavily on skilled foreign workers.

The Trump administration, dissatisfied with the court’s decision, has announced its intention to appeal. Officials expressed optimism that the ruling would ultimately be overturned in higher courts.

The H-1B visa program is designed to allow U.S. employers to recruit highly skilled foreign professionals in specialized fields. Annually, a total of 65,000 visas are available under the regular quota, with an additional 20,000 designated for applicants possessing advanced degrees. Indian nationals represent the largest group of H-1B visa holders.

Prior to the introduction of the $100,000 fee, employers typically incurred several thousand dollars in costs related to processing and filing these visa applications. The fee was part of a broader strategy to promote the hiring of American workers over foreign labor. However, the court’s ruling means that this fee cannot be applied unless a higher court overturns the decision on appeal.
